    Default Child Support for Families With a Lot of Children

    My question involves child support in the State of: CALIFORNIA

    I have 5 children, a single mom, the father is no longer in the household, and the father doesn't want to work. I am not receiving any child support from the father. I work 2 jobs to support my children. However it is not enough so I am receiving a supplement from Social Service. I am working on the arrangements for physical and custodial custody.

    My first question: Is there a difference between physical and custodial custody? My children lives with me.

    2nd question: What is the law in California in making dead beats dad support their children?

    What is the amount I should receive for my 5 children?

    What happens if father doesn't pay child support?

    1. physical custody, your child lives with you. "custodial" custody (this is the first time I've heard this term) I assume, refers to who makes the decisions, medical, school, activities, etc for the children.

    2. Contact your local child support agency and ask them.

    3. This is based on calculations using his income, your income, previous children, insurance, daycare, and possibly some other factors.

    4. Contact your local child support agency and ask them.

    There is no such thing as custodial custody. Physical custody determines who the children live with. Legal custody determines who gets to make legal decisions regarding the child(ren) i.e. school, medical, educational, religious...

    There is no law making "dead beat dads" support their children, because that would be unconstitutional. There is a such thing as a dead beat mom, and I can bring a whole lot of custodial dads on this forum to prove it.

    The law is quite simple. The adjudicated parents of children have the legal duty to provide support to their children. If they do not support their children after being ordered to do so, they can be subject to criminal prosecution. It is a misdemeanor.
    What is the amount I should receive for my 5 children?
    If you're on welfare (or go on welfare), then you get $50 of what they collect. The rest goes back to the taxpayers for supporting your children.
    What happens if father doesn't pay child support?
    That depends. Were you two married? Are these children of the marriage? If you were not married, has he been legally declared the father of the children? Is there a court order for support currently? Has he been served with any legal papers? Does he have a job? Do you know where he is?

    If there is no order for support then nothing will happen to him for not supporting the children, especially if there is no legal determination that he is the childrens' father. If he hasn't been legally declared the childrens' father, then he (legally) has no children.

    If there is an order for support and he doesn't pay it, then he'll have his driver license suspended, any professional licenses he may hold pulled, liens on any property he may have, income tax refunds intercepted (if he gets a refund), etc.
