    Default Unfair Jail Time for Probation Violation

    My question involves criminal law for the state of: Virginia

    My husband was given a 1 year sentence for not being able to pay the Alcohol and Substance Abuse Program he was ordered to a plus they ordered him to go to Counseling and he had missed 2 classes. Thats it.

    His court appointed attorney told him he would not get any jail time. He never met with him just talked to him on the phone.

    The same judge that did this has in 2 cases of manslaughter only given the accused 18 months jail! One had four counts of manslaughter!

    Is there anything I can do?

    Judges have great discretion in sentencing and provided the sentence is within that authorized by law there's probably nothing you can do--counsel might file a motion for reconsideration but it would be a longshot that the judge would change his/her mind.
