    Default Divorce Dissolution Paperwork

    My question involves divorce in the State of: Ohio

    In the seperation agreement there is a page where you list your debts, what kind they are, and for how much and -who- is responsible.

    My idiot lowlife husband racked up a TON of debt in the 2 years since Ive left him.. Well approx 20k worth.

    So I have about 8 spaces to add in all this, but he has -21- different places he owes money to that I need to list, as well as 3-4 of mine.

    Things like loans, his bank account (over 1k in overdraft fees...), like 4 different cash advance places, plus utilities.

    Do I have to add these all in?

    Should I?

    He wracked up every bit of it (besides his truck loan that he has since defaulted on, and had repossessed.) after I left him physically.

    If so, can I do 2/3 of the same page to add in? (ie 3 copies of that particular page)

    The form you're filling out is to be given to whom? Normally, if there's not enough room on a form, you can indicate that more information is provided on an attachment then attach a sheet with the information that wouldn't fit onto the form.

    There are waviers, dissolution, and separation papers. The debt part is in the separation set of papers, basically outlining who gets what. We dont have anything other than personal debt though :P (ie no house, not fighting over cars ect)

    If the debt is HIS and not yours (not joint account holder) why are you listing them if the debt occured while you were seperated? Your bills are yours and his are his in this wonderful state. You have no assets. You need to make sure that by doing this you are not taking on his debt in the agreement. (Mine did the same thing, I didn't want his bills anymore than I wanted him...lol)

    Ok so in Ohio, basically if all the accounts that are his, are in his name only, and hes racked them up since Ive left him, I dont have to list them in the separation agreement?

    I mean legally even if I didnt list them, since my name isnt on any of the accounts they couldnt come after me to pay them could they? (collective they as in anyone he owes lol) Since my credit wasnt used to obtain any of the various credit cards, payday loans, or to open any utilities that he now owes?

    Since Im the only one filling it all out Im making sure that his stay his, and mine stay mine. So there is no way he can stick me unknowingly with his debt. (haha).. that he plans to pawn off in a bankruptcy.

    I'm not an attorney, but when I had this problem I simply told the collectors that I was not legally married anymore (although I was)and that if they attempted to contact me again that I would sue them. It was bad enought that I got my # changed. I had it written in the sep agreement that all debts were owed and owned by the individual. Once the seperation was legal (I did have an attorney do the work) I was covered. My situation was a bit different as we had assets. I couldn't list them (his bills) bc I'm not privie to them. What he does is his business and not mine and vice versa. How could you list them all unless you know them all? You can't. You also cant legally obtain them. However, I would run a credit report on yourself if I were you. This way you are certain that you are not on the hook. It is VERY EASY for him to list you as a joint holder without you being aware. Or even just get a card in your name. I would do this prior to filing any paperwork. It may behove you to hire a paralegal to assist you.

    Oh I dont mind doing it, as he gave me a detailed list.. I just want to make sure its okay to just make copies of the same page to fill it out. (Ive actually scanned them into the computer, and Ive been typing in the information through PSP.) So it isn't a problem to hand them 3 pages of page 7 of the separation agreement?
