    Exclamation What Can Happen to a Child After Emancipation

    My question involves emancipation laws for the State of: North Carolina
    Hello,
    I have read into the laws and some of the posts. So my question comes from a fear of my sister being put into a foster home or some kind. She had heard that if my mother puts her up for emancipation the state will put her in a home, all of her family lives on the opposite side of the U.S. and we would not be notified in a reasonable matter because there are already so many children w/out families. If my sister is emancipated could she be put in a home? or would she be allowed to find a home/place to live on her own. We have talked about bring her back home if it goes through. BUT my mother does not allow her to have a job. How is she going to prove she can provide for herself? would they consider family talking her in an exception.... I realize it would not be a defiant answer but does it sound like it would be considered?

    Emancipation is a legal process whereby a minor becomes recognized as an adult - thus, if she were emanicpated, the state would treat her like any other adult - meaning, no, they won't put her in a home. She'd be on her own to take care of herself.

    The court won't care a hill of beans about what COULD be...they will only consider any job that she's already working. If mom won't allow her to be employed to the satisfaction of the court that she makes enough to support herself, there is no hope for emancipation (unless she somehow has a MAJOR trust fund somewhere).

    No. Emancipation is about providing for yourself 100%. Living with family isn't going to cut it with the court. What the family COULD do is check with your local county court's website under the probate section and learn about the process of guardianship. It's possible that some other family member could successfully become her legal guardian and take her in.

    Hello again..
    Thank you that helped so much... it confirmed my common sense idea of the matter but ya never know... so do you have any ideas on were i can find information about a mother trying to put her teenager up for adoption... my mother keeps threatening my sister and now that i know emancipation is a empty threat i am curious if the threat of putting a teenager (for no reason except shes acting out a little) up for adoption is realistic in north Carolina. well never mind there is more to the situation child services have been called out on my mother and her new husband and they keep taps on the family from time to time and my mom and sister are suppose to seek counseling.

    How old is your sister?

    Why don't you contact mom, pretend as if you know nothing about the situation, and just ask her if she would let sis come stay with you for a while 'cause you miss her and want to spend time with her?

    If she REALLY wants to be rid of sis, she will say yes, and you won't have to keep worrying.

    If she is actually just making empty threats, you will know, and can offer sis some measure of comfort.
