    Default Ex-Husband Left Property

    My question involves personal property located in the State of: Alabama. My divorce was final at the beginning of December 2007. In the papers it states that my ex is entitled to his tools, his grill, and some furniture. He still has not come to get any of his things (and a bunch of clothes are still here). What are my rights in regards to getting rid of the property that was named as his in the divorce. I have been storing it for 8 months. We discussed that I would give him another 2 months to get it - but I want to follow proper legal channels if he does not get it at the end of the additional 2 months that I have given him. Thanks in advance for any information.

    Give him a set date to retrieve all his belongings. Once that date has passed, if he has not made an attempt to retrieve the items. You may consider them abandoned. Once you have done that you may take ownership of them.

    I dealt with the same thing with an ex once. This is exactly what my lawyer told me to do.

    You got part of that right - she needs to be asking her lawyer about this. She can't assume that what worked in your case, with your judgment, in your state will work for her.

    I had no case, no judgement, mine was also not a divorce. It was my exg/f. She decided to move out and see another guy in another state. I repeatedly asked her to come get her stuff. She kept saying when I was good and ready. Well I asked my lawyer what to do. He advised me to do what I stated. So I did, needless to say I was nice enough to take all her stuff I didn't want to her parents house.

    The thing with this case is, she was married now divorce. But property laws and establishing ownership is vague. I looked up property laws for Alabama. What I stated is basically what the law states. How ever there is a judgement with this persons situation.
