    Question Deadline for Paperwork After a Court Ordered Name Change

    My question involves name change laws in the State of: Texas

    Ok. The court ordered a name change for my daughter more than a year ago. The biological father still has not finished the paperwork. Is there a limit to how long he has to do this, or could he do it 10 years from now? Apparently, her name is still the same until he finishes whatever paperwork comes after a court order.

    What is he having to fill out that he still hasn't?? And is there a deadline for any of it?

    What exact paperwork does he need to complete, and why can't you complete it yourself or bypass the requirement with a court order?

    I have no idea what the paperwork is. He has it, the court ruled in his favor. His mother just said that he still hadn't filled it out. I wish I knew what it was so I would know whether or not it was important, but he refuses to tell me exactly what it is. All he will say is that it is paperwork from the name change.

    I kind of need to know what her name is... Until he fills it all out, apparently, it's still the same as it was a year ago and the year before that. So if, next year, I go to file taxes and he still hasn't changed it, I guess I just use the name she has had all her life instead of the one that the judge decided to give her?

    Will I be notified when her name change is completed? Do you know what paperwork it is? Help! I'm confused! Lol.

    Up to that point in time when the child's name is changed, the child's name remains unchanged.

    So in 5 years, if he still hasn't done it and he decides to do it, he can just fill out the paperwork and change it without telling me? There's no limit on how long he has to do that?

    If you're eager for a final order, complete the process yourself. If you're hoping that the name change never goes through, assuming this was an independent name change action and not part of your custody case, ask the court at what point they're going to close out the file or move it to the inactive docket, and what the father would have to do to reinstate the case after that happens.


    You don't appear know what happened, and we're dependent upon you to tell us. Consider consulting a local lawyer.
