    Unhappy Ex-Wife Denial to Sign Consent for U.S. Passport for Children

    My question involves a child custody case from the State of: Virginia.

    My husband has shared custody of his children being the mother the primary custodian, eventhough the kids spend [B]half of the time in both houses; special celebrations such as Thanksgiving and Christmas time happen every other year with each parent.

    We have booked our trip to Mexico (Monterrey, Nuevo Leon) for Christmas (we went 2 years ago but US passport was not required back then) and now the ex-wife have said she won't sign the consent required to process the kid's passports. She is usually playing dirty games like this and we are not sure if legally we can make her sign since this Christmas time corresponds to my husband this year and we don't see the wrong of dangerous of traveling to my hometown. What can be done in this case? It is not is not fair for the children who are looking forward to this vacation.

    As is explained here, the most obvious thing you can do is get a "Court order specifically permitting applying parent's or guardian's travel with the child".

    In your opinion, what are the chances we have a court favors our case? Is this based in "the best interest of the children" rule?

    I don't know anything about your case. You will present your evidence that the refusal is unreasonable, and your ex- will be able to present her evidence that her refusal is based on... whatever basis she has for refusing to consent to the passport. Then the judge will decide.
