    Default Missed Court Date and Traveling Abroad

    My question involves criminal law for the state of: AZ

    Back in 1995 or 1996 I received a registered letter to appear in court in Tucson but when I received the letter it was already after the court date. Since then I've not heard anything regarding the case and have just gone about my life. It was due to theft of money at a previous job I worked at. I'm traveling to the UK at the end of the month and want to make sure everything is okay and if not I'd like to know how I can get things cleared up or find out what if anything is out there. Like is the case still open? Is there a warrant? Where do I find out any information? What will happen to me if I try to find out any info? How quickly can it be cleared up if there is something out there? It's a first time offense and it's been years and I'm wondering if anything is out there. I'm no longer in Tucson but have and still live in the the state of Arizona. Any advice or information would be appreciated. Thank you for your time.

    You can try it with or without an attorney but the best place to check is within the jurisdiction where the offense is alleged to have occurred--such as the law enforcement agencies or courts in that jurisdiction. I don't know about AZ but in some places a citizen can pay to have a records check with the State Police for example which would turn up outstanding warrants IF they were properly entered. Ultimately, NCIC is the best database to check--access to it is restricted although a friend you may have working for a criminal justice agency may be able to access it provided it is for a legitimate law enforcement purpose.

    If there is a warrant it is anyone's guess as to how long it may take to clear it up--that depends on many factors and you may have a failure to appear in addition to the underlying charge to clear up--counsel usually helps in the long haul.

    Thank you for the information. I agree getting legal help is going to be necessary. I doubt it's something I can clear up on my own. I'll have to contact someone and go from there. I'm guessing something has to be there because I don't think it just goes away and if something is there because its been so long what might happen? Anyone know?
