My question involves collection proceedings in the State of: TN
OK so here is the deal. I have a Credit Card thru Chase and I am currently 14 days late and $200 over the limit. I have had 2 numbers show up on my caller id, being: 847-488-3313 and 210-586-0006. I have answered and they are both calling for my Chase credit card. I have had reps leave notes on my file and no matter which numbre I call they can see the notes so I know they are linked and/or working together. The problem I am having is the volume of calls. Here is today's call log:
8:48 AM - 210
9:06 AM - 847
10:18 AM - 210
11:12 AM - 847
11:50 AM - 210
12:08 PM - 847
1:03 PM - 210
1:10 PM - 847
1:53 PM - 210
2:28 PM - 210
2:47 PM - 210
8:09 PM - 210
8:27 PM - 847
So for Sunday that was 13 calls total. This was a light day as on Friday call total was 21 and I had 5 calls inside 45 minutes. Now please note that at 3pm I called and lit a fire under someones ass about the calls and they stopped for a few hours, but i know come monday it will be the same. This has been going on for about a week. So here is my question: Is this a violation? It is 2 seperate numbers but all for the same creditor with the same account.
I found this http://www.ftc.gov/bcp/edu/pubs/cons...edit/cre27.pdf
806. Harassment or abuse
A debt collector may not engage in any conduct the natural
consequence of which is to harass, oppress, or abuse any
person in connection with the collection of a debt. Without
limiting the general application of the foregoing, the following
conduct is a violation of this section:
(5) Causing a telephone to ring or engaging any person
in telephone conversation repeatedly or continuously
with intent to annoy, abuse, or harass any person at the
called number.
The key words for me here are causing a telephone to ring repeatedly and continuously with intent to annoy. For me 3 calls in one hour is that. What can I do or is this legal?
Please help!!!
