In 2007 I legally entered the USA with an H1-B visa; good until 2010.
In 2007, my husband (boyfriend at the time) became an LPR. He intends to apply for citizenship in 2011.
In 2008, we married, had a child, and I moved locations in order to live together. My old work location is too far away (200 miles), so I must resign.
Currently, I am seeking new employment and wish to get a new visa. I understand that if I resign, I will lose my current visa and face deportation.
(1) What happens if I do not leave?
(2) Is immigration lenient / understanding in this kind of situation?
My husband has already filed an I-130 for me, but I understand this will take years to complete.
(3) What options do I have, to try to remain legal, aside from an employment-based visa, which I'm already trying to do?
(4) If I do leave, is there any kind of visa that will allow me to re-enter and live with my husband and baby? I do not care if I work or not. Stay-home mom, school, or work are fine with me.
