My question involves towing laws for the State of: MA
1. My car is towed in Friday midnight. I called the towing company Saturday morning, they told me the apartment management asked to tow the car in 11:30PM. I paid $150 cash to get back my car.
2. My apartment management sent out new parking tags several weeks ago.
3. They did post the general notices saying cars without tags will be towed in recent weeks.
4. I have the tag under the windshield. Although the tag's shape is designed to hang on the rear mirror. I choose put it under the windshield and it is reasonably "visible" by any definition. (it's a convertible, the tag will fly away if hanged on rear mirror).
My questions are:
1. Can I talk to the manager in charge to get my money back? any suggestion on how to address the issue?
2. If she refuse, will it help if I tell her I will complain to her supervisor? (the apartment is owned and managed by a private real-estate investment company)
3. If she refuse, will it help if I tell her I will sue them in small claims court?
4. Any general suggestion to really go for the small claims court in MA?
