    Default Mom Going After Dad

    My question involves child support in the State of: California

    I'm 21 years old and in this state there is no statute if limitations on child support. My father has never once payed child support on the agreement with my mother that he would help me with college. I've been at a JC for the past 3 years, so we've been able to afford it. Now I am transferring to an expensive 4-year college to complete my degree, I need his help, but he won't give me any money and won't even cosign a loan with me. This is the last straw for my mother and I, she has started looking for a lawyer.

    My Questions:
    1) What is the process to execute this? Any advice for my mother and I in pursuing this?

    2) What are the chances we'll get my dad to pay up?

    Are you saying that there was only an agreement between your parents, and never an order from a COURT that your father pay child support? If that's the case, I don't like your chances at this late date.

    there is a court order $500 a month which he never payed because he said he would help me with college. sorry should ahve been more clear.

    It will depend on why she has not pursued the CS and the defenses allowed by your state. She simply needs to have a Rule to Show Cause hearing. An attorney will likely take it on a contingency.
