    Thumbs up M.I.P. for Alcohol and Retail Fraud 3rd Degree Charge

    My question involves criminal law for the state of: Michigan

    I was caught concealing alcohol at a meijer store in november of 2007. When i got caught, i followed every instruction they gave me and therefore i wasnt arrested and the cops were not called. In michigan, meijer does not prosecute people who pay back the requested amount (10x product value) 30 days from the the date your caught. Since i was 18 at the time, they have no choice but to prosecute me for the alcohol (MIP) which i expected.

    The problem is that i just paid the amount I owed to the store (10x product value) a few days ago (July 29 2008) and since i never appeared in court for the MIP, i now have a warrant out for my arrest in that county and they are now charging me with retail fraud in the 3rd degree and the MIP. I am going to appear in court in a couple weeks to take care of this so i would like to know what i can expect to happen to me. will i just be fined and get some probation or will it be something more serious like jail time?

    ps. this is my first time ever getting into any trouble with the law and the only reason it took so long to pay the store back was because i was jobless in college at the time and i needed to come home for the summer to work and make the money to pay them back, if that makes any difference.

    Get a lawyer, and talk to your lawyer about how to best turn yourself in without spending a night in jail, and how you might be able to resolve your criminal charges without getting a criminal conviction. (For the warrant, generally speaking, you would want to turn yourself in early in the morning on a weekday, so you can get before the judge who issued the warrant that same day, and have somebody prepared to post any required bond.)

    You may also have an inflated amount owed to the store.

    If they took you to court for the civil demand you didn't pay, you can include their legal costs and court costs... which could easily double the amount you pay.

    Why didn't you call them and tell them it was going to take a bit to get them the money?

    You ignored the demand for 7 months... they thought you skipped.

    what would the possibility be that i might get hyta (holmes youthful trainee act michigan) probation and perhaps have this off of my record in a few years? Also, if i had to pay alot more money in fines to the court, how long would i have to pay it? Would i have to pay fines that day when i go to court or would i have an extended period of time to get them the money.

    p.s.- i plan to plead guilty when i get there
