My question involves landlord-tenant law in the State of: California. Recently I moved into a roommate situation. Both my roommate and I are on the lease. Since moving in my roommate has requested that I or my children are not home on Wednesday during the day because she would like to have company. This issue did not come up until about one week after I moved in. Since then the situation has become volatile because I cannot guarantee that my children will not be there on Wednesdays and quite frankly had she asked me this from the beginning I would have told her no and would not have signed a lease with the landlord. Long story short, I cannot live in this situation any longer. One of us has to leave. She cannot pay the total rent by herself but I can so I suggested she leave but obviously I cannot make her leave. I would like to leave since she cannot because I can't take the yelling and screaming anymore especially around and in front of my small children (10 & 11). Is there a way I can legally break my lease? I have 5 months left on the lease.
