    Default Payment at "Piece Rate" is Below Minimum Wage

    My question involves employment and labor law for the state of: Ontario

    Okay, some of my friends work in a clothes manufacturing factory that pays by the "piece rate", meaning that you get paid according to how much you sew, and not by a fixed hourly rate.

    Most of the time, they only make about $5 dollars an hour, and well below the minimum wage set by the McGuinty Government of $8 an hour.

    Is this legal? Could they sue for violating their pay rights?

    This is primarily a US site. You're going to have to find a Canadian site to answer your question - I don't think anyone here knows Canadian law.
