    Default Sealed Case, and Answering Employment Questions of Arrest

    My question involves criminal records for the state of: MA

    I have a dismissed A&B case in MA that has been sealed. When asked on a job application if I have been arrested, can I answer in the negative? This was an outright dismissal (no deferred sentence or anything).

    If you were arrested then you should answer the question truthfully. If it asks you if you were convicted, then it's a no.

    You have to read how the question re criminal hx is worded on the application & answer truthfully.

    It all depends on your state's law concerning the effect of an expungement or sealing of the record. For example in my state we have a statute specifically providing that once the record is sealed, sequestered, or expunged the applicant may state in the employment application that they have never been arrested, convicted, charged, etc. with the offense. That is one of the main purposes for the procedure in the first place and thus the law protects the applicant. Your law may be different.

    I can't believe that someone can make false dv accusations to obtain custody of a child and inadvertently ruin a career in the process. Once the shadow of doubt is cast, how does one lift it? I have two masters degrees from top universities, have worked for some of the best companies in the USA, owned my own business, paid mega taxes, etc... My fault for getting married to a ticking latin bombshell I suppose.

    I have European citizenship and am seriously considering just moving from this country that has lost site of due process and the consitutional rights that once made it a great country.
