    Default Charged with Possession, But I Didn't Buy Any Pot

    My question involves criminal law for the state of: MICHIGAN

    The whole story the way it happened:
    By the way i'm 17.
    Me and two friends were waiting in a parking lot so they could buy pot.I stayed in the car because i was not smoking. After they bought the pot they were walking back to the truck and they started running because someone saw them(Bad idea on there part). So when we drove away we went and parked for a little bit, while they rolled the blunt. We then drove away so they could take my friend home and they were gonna smoke it on the way. Well we seen some cops so we went a different way. Then we are driving and then a car is behind us then he flicks his lights. So we are pulled over they come to the car and they asked what we been doing..blah. Then they ask to search us they search us and find no pot on us. Well my friend tossed the blunt in the car somewhere(no idea why). Well when were out they talk to us ask were we been and what not. Then he's searching the car and he finds the rolled blunt. He then pulls me over for no specific reason but he picks me. Asked me the story i told him that THEY went and were buying pot and i did not pay any money for that pot. Then he tells me to go to the cop car were i sit for a half hour. I'm told to get out of the car then i get a hot possesion charge and told to go home.

    1.) should i try to fight this?
    2.) How should i plead?
    3.) anything i can do to get out of this?

    Think of it this way....

    Would you be any less guilty of the bank robbery if you drove the getaway car?

    1) Definately. You need an attorney. This could easily effect a great portion of your life.

    2) Ask your attorney... I am guessing guilty to a lesser charge as part of a plea bargain.

    3) Yeah, get your friend to admit the blunt was his.

    Honestly, you are lucky they let you keep the car.

    Being a driver of a getaway car for a bank robbery is way different than your friends had pot on them and you got in trouble too.

    You drove the car and knowingly facilitated an illegal act. That makes you an accessory. Just like waiting for the guys in the bank to get done with the robbery.

    Compounded with the fact that the grass was found in YOUR car... and, I am assuming, your good friend didn't fess up to his ownership of it... you get to take the fall.

    In the absence of other evidence, the owner of the car is responsible for everything in it.

    They could have, in some instances, taken a car used in the commission of an illegal act.

    You are going to get a fine no matter what. You are also going to have to come out of pocket for an attorney... this is not a DIY project.

    and it wasn't my car.

    So...
    Now what kind of trouble am i in.

    You can try to convince the prosecutor/judge/jury that although you went along on the drug buy, and were in the car while drugs were being used, you had nothing to do with any of those illegal acts and did not take so much as a puff. If you were on the jury, would you believe you?

    Why would they of taken the car?It was just a blunt of weed.
    but...
    I cant get an attorney for a ticket that is only gonna be a couple hundred dollars.

    But can they really charge me with possesion of marijuana?

    And if i plead guilty is there a chance that they may waive the fee and give me probation and drops?
    And if i plead not guilty does that destroy all chances of getting the fee waived?

    All i'm really worried about is not having to pay for this and not having it on my record.
