    Concur with Betty. Unfortunate as it may be, unless there are a minimum of 50 employees within 75 miles of your location, you do not qualify for FMLA or the CA equivalent.

    That being the case, it is entirely up to your employer how much time off to grant you, no matter how much vacation time you may have available.

    Betty3 & CBG - Thank you so much once again. All of you have done a big favor to me by replying so promptly.........

    I understand the limitation of the laws now. I wonder why it has to be 50!

    I just wish there was a way I could get this much needed vacation without losing my job.............

    Have you explained to your employer why you must have 20 days of paid vacation and told it it whatever you must to do related to a personal family issue during your absence? You are asking for a four week absence from work. Although, you haven't indicated your job, that's a lot of time for an employee to be away from work without a compelling reason. It's also a lot of time given that technology allows so much to be accomplished without your physical presence.

    If you can, you should consider breaking your leave request into periods more acceptable to your employer. Unless there is some absolutely compelling reason for a 20 day absence and the period can't be reduced or segmented, I can't imagine giving up a job in this economy.

    Mitousmom - Thank you for the suggestions. I am still trying to convince them to give me 3 weeks instead. They might agree. Technology still can't replace human emotion and support. You are right, resigning should not be an option.
