My question involves landlord-tenant law in the State of: New Jersey
Is there a legal or a court-approved definition of a 30- or 60-day notice and how it is supposed to be calculated? Is it based on the number of calendar days?
My lease requires a 60-days notice to terminate the lease and vacate the apt. My notice to landlord was sent (and received) via email on 7/2, informing him of my intention to vacate on 8/31.
According to my calculations, there are exactly 60 days between the date of the notice, July 2nd (NOT counting this day) and requested end-of-lease date, Aug 31st (including this day).
My landlord is claiming the notice is two days late and wants to hold me responsible for one additional month's rent (for Sept). Is he right?
