    Default Foster Care and "Loans"

    My question involves collection proceedings in the State of: California

    The question is for my wife.

    She was in foster care for about 4 years (from 15 to 19); she was living with a family when she began her Fall Semester at one of the local colleges. The Foster family said they would take 'care' of all the financial issues, such as helping her apply for grants, aid, ETC. Well, the foster parents took the money, kept it in a personal account (to "safe-guard") and that was that. Well about 2 months after school started (Novemberish of 2006) my wife was kicked out of the house by the foster family and was forced to live with her friend up until December. She then had to fly to Washington to stay for 6 months before I could finish my schooling and provide for us.

    Now, here in 2008. We get a notice from the Federal Student Aid requesting that we pay for an amount of the loan.

    Is there any way around this? She had no access to the money at the time. Still hasn't used it, nor seen it.

    Any help would be great. Thanks!

    If you're talking about Federal loans, then that money is usually disbursed through the university. Payments for tuition and other expenses are withdrawn, then any leftover funds are refunded to the student at the end of the term. The refund is usually in the form of a check made payable to the student, so I don't understand how her foster family was able to keep any of the funds.

    Your wife will be responsible for the costs of the term she was enrolled, even though she didn't complete it. You might want to contact the university about the other funds.
