I have lived in my house for 5 years. About 3 years ago I put up a fence in place of an old decrepit fence, with the consent of my neighbor. He has since sold, and there have been three other owners since the fenced was replaced in just 3 years. The latest owner wants the fence either replaced or removed because she claims that her side of the fence is ugly and also that the fence is encroaching on her property. The "new" fence was put in exactly where the old fence was. No one has had a survey. I told her that I would split the cost of the fence with her, and she said that she didn't want to contribute to the expense of a new fence. She then said that she wanted it completely removed. I told her that she can have it surveyed and go from there. I am in the process of selling my house and just got a letter from her attorney regarding this dispute. What do I have to do- do I need to hire an attorney. Should I contact hers, or should I have her get it surveyed- since there have been 4 owners since the fence was put up- and none of them complained about the fence?
