    Default Receiving Credit for Back Time in the State of Texas

    My question involves criminal law for the state of: TEXAS

    My husband is serving a 9 month sentence for avading arrest. In court he was told that he would recieve the 2 months credit for the initial arrest. The judge later decided not to grant the back time due to the fact that he had a failure to appear. I thought that if the judge did not agree with the plea agreement the defendant had the right to withdraw the plea? My question is how can we get him back time credit restored? I have heard about sentence reduction in the past and I would like to know how we could qualify for that.

    The Prison system has no control over sentencing. Your brother will have to obtain a lawyer and file for an appeal. But that is alot of money for 2 months. Also by the time it is all done with he most likely be out.
