My question involves criminal law for the state of: Missouri
So my idiot brother is in college and was working at a resturant as a waiter. He got caught adding a dollar or two to some of the credit card payments when it was easy to change the number, by the managment when a customer called in to complain. The police were called and he was fired. He gave a statement to the police that he had done this a few times for a total of less than 50 dollars combined. He is now freaking out that he will be prosecuted. What does anyone think the prosecutor might do? I told him that he probably doesn't have anything to worry about, but after doing some research it looks like fraud and theft. Any advice would be greatly appreciated. To my knowledge the DA has not contacted him and no warrant has been issued.
