    Question Wrongly Accused of Harassment by a Business

    I called four or five times a Firestone store to get a car part fix becaouse the damage it and the owner was trying toget out of it making stupid excuses and henging up the phone. He didn't want even listen to me, each time I nicelly ask him not to heng up the phone he still did it. On the thirt phone call he sad he will call the police and hang up on m. On the fourt call he had a policmen on the phone and I talk to the cap, the owner lie to the policeman that a called him 12 times and that a was harassing him. I didn't say a bed word to him becouse every time a try to seek to him he heng up on me. The cap told me to cometo the shop with the brouken tire that he will fix it, he olso asked me if I want him to be there so I wouldn't fill tretenet by him I sed yes, but when a got there he check my car for any incorections and then he asked for my DL I asked way and he got upset and told that he need to file a report that we had a dispute so O.K . Next day a went toget a copy of the report and it sad totally diffrent things that the cap sad, I was as a offender for a harassment by phone. So my question is my story dosent count, the owner was lieing, he try to skier me of becaouse I'm a woman and I 'm from a diffrent country but sill a citizen. From my knowlage if i was calling a businesse becouse they did a service to my car that was not good, I have the right to call them or not? And olso the cap that was at that time gets service for his car there, he know him so is that right to...? Please help me because I'm very confuse about the custumer rigths and police service....

    If you can't resolve the repair of the part with the dealership, sue them in small claims court. It's time to stop calling them - that should be 100% clear to you after the police involvement.

    that was my first time calling, and they didn't even give me the chance to talk to them, I don't want to go back there I will pay out of my packed, but my question was, if the owner of the business had the right to do this to me, and a never sad anything bed to him.....also the cap knows this owner sooo isn't that taking taking one side over another even if he didn't have any evidence of harassment.....and I called him 3 times because he didn't wanted to talk to me and the fourth time was when I talk to the cap....and form my knowledge if you are calling a business about a service they did is not harassment....???

    You do have the right to calmly voice a complaint to a business... but not to harass them. If you say you did not harass and only called 3-4 times and was hung up on, then this should be fairly simply to prove in court when you sue for the tire damages and perhaps harassment against you and wrongful police report.

    After you file your case in small claims, you may be able to subpoena the phone company for records of your calls. That should show the number of calls and the length of time the call lasted. If it was extremely brief it may support a hangup. Then, also for future keep in mind that it is helpful to you to have a witness when dealng with such opposition. Also, a letter to the store will document your complaint better and serve as proof.

    Side with caution on this one. Some/many states have a clause/section in thier telephone/telecommunications harassment statute that states once a person is told to stop calling that #, they must cease and desisit. I doubt it exhonerates a customer doing business and whether you were polite or angry.


    I am not saying you are a trouble customer, mind you, but some would call a business 10 times in an hour on the hour.

    If you have not reached a proposed settlement to your grievance by phone, then a certified letter outlining your complaint is in order OR if it is a large corp. try contacting the regional office etc.

    If you are ingored and you believe you have a case, sue in small claims.

    I personally would advise not to call anymore as a precautionary legal move, you gave them thier chance.
