Personal CD Copyright

My daughter has made a CD at a local recording studio. The deal included 5 free copies, then you purchase however many more you need. It's only a demo and although she might sell it for a minimum amount to her friends it is not for shop resale. The studio took a photo of her and has put it on the CD. If I wanted to make more copies of this CD instead of buying them from the studio, how do I stand with the copyright of the CD and the photo?

Usually there is a contract included with the purchase of such CDs outlining what you may or may not do with it.

Were there any verbal agreements discussed before recording?

Normally, the songs are owned by the artist. The studio has no rights when it comes to the songs, or the printed product, unless agreed upon in a contract.

The photograph, however, is another story. The photo taken at the studio is the copyright of the photographer. I would avoid using that photo for future pressings of that CD.

In short - if the songs were written by your daughter, she can copy these songs however she sees fit, as she is the copyright holder.
