    Default Oklahoma Emancipation Laws

    I've heard that Oklahoma only emancipates minors when they graduate from high school or turn 18. My 15 year old stepdaughter is pregnant and can't qualify for state help (for her prenatal care) with our household income being so high. My husband's insurance won't cover a teenage pregnancy, so we need information on whether or not it would be possible to emancipate her - so that she could live outside our home and subsequently get the medical help she needs.

    Default Oklahoma Emancpation Law

    Oklahoma has some provisions which can be used confer certain rights upon a minor, but those provisions do not "emancipate" the minor as such. Instead, they give the minor the right to enter into binding contracts:
    Quote Quoting Oklahoma Proceedings to Confer Rights of Majority
    §10 91. Authority of district courts.
    The district courts shall have authority to confer upon minors the rights of majority concerning contracts, and to authorize and empower any person, under the age of eighteen (18) years, to transact business in general, or any business specified, with the same effect as if such act or thing were done by a person above that age; and every act done by a person so authorized shall have the same force and effect in law as if done by persons at the age of majority.

    §10 92. Procedure to confer rights of majority Petition Jurisdiction and venue Decree.
    Any minor desiring to obtain the rights of majority for the purpose named in Section 91 of this title may, by his next friend, file a verified petition in the district court of the county in which such minor shall reside, or, if the minor is a nonresident of the State of Oklahoma, said verified petition shall be filed in the county in Oklahoma where said minor owns real estate, setting forth the age of the minor petitioner and that said petitioner is then and has been a bona fide resident of such county for at least one (1) year next before the filing of the petition, or that said minor is a nonresident owning property within the State of Oklahoma, and the cause for which the petitioner seeks to obtain the rights of majority. The petition should state whether or not the parents of the minor are living, and if living, their names and addresses; whether or not a guardian has been appointed for the minor and, if a guardian has been appointed, the guardian's name and address; who has legal custody of the minor and, if the person having legal custody is not a parent or the guardian, the name and address of the person who has custody. And the district court being satisfied that the said petitioner is a person of sound mind and able to transact his affairs, and that the interests of the petitioner will be thereby promoted, may, in its discretion, order and decree that the petitioner be empowered to exercise the rights of majority for all purposes mentioned in this act.
    Although I haven't yet found Oklahoma authority, most states regard a minor as emancipated once she has a entered lawful marriage.

    Default Oklahoma 15 year old

    If she doesn't get married, though, and moves out - it sounds like we would still be legally responsible for her. Is that right? For instance if the baby doesn't get taken care of properly, we would be in trouble, also?

    Default Parents' Responsibility for Children

    Oklahoma requires parents to support their children. The state would step in, if this were a case of abandonment, but that doesn't seem quite right. You may wish to explore whether there are any low cost insurance plans available through the hospital where she is receiving prenatal care - in some states there are some affordable plans available without regard to means.

    Please Do Not believe what was just told to you. I am a emancipated citzen and it is not that difficult to become emancipated. All I needed to do was to prove that I could live on my own and show that I have someone to fall back on just in case. I had two lawyers, two jobs, good grades in school, and a apartment. I have been emancipated for one year in a few months now. I am now seventeen. Also my parents have not been responcable for me in anyway. When a person is emancipated they have to be able to take care of Themselves. If they break the law, they are the ones who get punished, not the parents.Clearly you have been misdirected, please if you need any information simply ask me...

    Not to mention the fact that there is no way on God's green earth that a pregnant 15 year old would be emancipated in ANY state.

    Not that complicated, yet you had two lawyers?

    It does scant good for you to declare that something is possible without laying out the legal framework by which it can be achieved. Please elucidate.
