    Default Ex-Roomate Issues

    My question involves a roommate in the State of: Texas

    On May 23rd, 2008, I left my 2 bedroom apartment in Dallas to move to Austin. The lease was supposed to end July 8, 2008. When I left, I cleaned my bedroom and made sure all of my possessions were out. I filled out the 30 day notice and left it on the counter in clear view needing my roommate's signature and for him to turn it in. Sometime between June 3-June 5, I sent a check for $514 to what I thought was the wrong address. I sent another check for that same amount to the correct one. That check was turned in.
    Since our lease ended on July 8, I sent a check for $125. That day, I was told by the leasing office that the 30 day notice was not turned in. Now, the lease expires the end of July. Moreover, the second $514 check sent early part of June was turned in as was the $125 check.

    I called my roommate and he said he did not know the lease was up July 8 and thought it was the end of the month. He has not called me back in a few days. Do I have any legal remedies at all?

    Probably not.

    You left the 30 day notice for your ex-roommate to fill out and turn in. You should have asked for his signature and turned it in yourself.

    Did he know you were leaving?

    You will probably have to turn in a new notice, and pay (at minimum) another month's rent.
