My question involves a roommate in the State of: Texas
On May 23rd, 2008, I left my 2 bedroom apartment in Dallas to move to Austin. The lease was supposed to end July 8, 2008. When I left, I cleaned my bedroom and made sure all of my possessions were out. I filled out the 30 day notice and left it on the counter in clear view needing my roommate's signature and for him to turn it in. Sometime between June 3-June 5, I sent a check for $514 to what I thought was the wrong address. I sent another check for that same amount to the correct one. That check was turned in.
Since our lease ended on July 8, I sent a check for $125. That day, I was told by the leasing office that the 30 day notice was not turned in. Now, the lease expires the end of July. Moreover, the second $514 check sent early part of June was turned in as was the $125 check.
I called my roommate and he said he did not know the lease was up July 8 and thought it was the end of the month. He has not called me back in a few days. Do I have any legal remedies at all?
