Absolutley NOT?
They are a surety to the court. They "may" have authority to arrest the Defendant out on bail, yes, under state law and Taylor v. Taintor, but NOT a co-signer.
IF the DF has appeared in court as required, even HIS arrest is questionable, as who will they turn him in to??
I don't see arrest of anyone being permissable!!
thank you for answering my question. I live in the state of alabama and the bondsman called me and told me he would arrest me if i did not pay the last three months amount, i didn't know so i took out a loan and paid them the last three months. my son the defendent has appeared in court every time he was suppose to. I appreciate you answering my question.
It is sometimes a common practice in such "collection" fields, that the intended is threatened with arrest for failure to abide by the terms of contract etc., and MOST of the time, it is bogus. Here, it was, just that!!!
ANY remedy by him would have been civil in nature!!
