    Default May a Married Woman Put The Biological Father's Name on the Birth Certificate

    I hope someone can help with this so here goes. Three years ago my husband moved out to live with his girlfriend. I have finally filed for divorce almost a year ago. I found out my ex-boyfriend and I will be having a child this March and by Ohio law cannot obtain my divorce until after the child is born. Well what name will be on the birth certificate? Can I add the real fathers name later? Thanks Barbara

    Default Paternity & Divorce

    It is my understanding that upon the birth of the child you would ask the County Child Support Enforcement Agency or Health Department to perform a DNA test of the child to resolve the issue of parentage. Your divorce lawyer, or the hospital where the child will be born, will probably have prior experience with similar situations and should be able to provide specifics.

    I am currently going thru the same thing. I was wondering, what name you had to put on the birth cert? I am still legally married, and pregnant by someone else. And I have heard different things. I can't even fill for divorce because I don't know where my ex is at. He is on the run from the police. Any advise you have would really help.

    Well I'm not sure how the whole putting the fathers name on the birth certificate works because I am having the same problem. However I had my son with my bf while still married to someone else. my son has HIS father's last name because YOU CAN NAME YOUR CHILD WHATEVER YOU WANT. so on my sons birth certificate it says father not stated but he has his fathers last name and not mine because i did not want him to have my married name since I hope to get a divorce soon. hopefully that helps you some
