    Default B&E and MDOP in Michigan

    My question involves criminal law for the state of: Michigan

    I went to michigan to stay with my girlfriend for a bit. I stayed at her brothers house for a month, I had a key to the house but did not recieve mail there. I stayed there every night, till about the last week in the month. I spent 4 nights somewhere else and when I had came back to the house at 1 am her brother was not there. My bedroom was locked with my animals and belongings and I only had a key to get into the house not into bedrooms. My cell phone was dead because i could not get my charger and I tried calling him and 911 on his house phone but they had no signal. I had a plane to catch at 8:25 am and I had waited till 3 am for him to come home and he did not. I panicked and attempted to kick the door down but could not then i cut the screen to the window, popped it open, and crawled through. He is stating I am being charged with B&E, MDOP, and another charge. I did not get all my belongings because I didn't have time, he now wants me to pay 130 for repairs and I agreed I would if he sent the rest of my things but he gave them away and this all happened about 2 weeks ago. I don't feel I should pay because the cost of my things was over $500.

    Should I refuse to pay? Or will that cause me to go to court? And if we did, would I have to worry?

    Did it not occur to you to give him a buzz the day before you decided to come back?

    Yes, you need to pay. You willfully damaged someone else's property.

    You also need to see if charges have actually been filed. Have you received a notice to appear in court yet? Have you contacted an attorney about this alleged charge?

    You've got bigger things to worry about than marrying your 17 year old girlfriend.

    He knew I was leaving on Sunday because he told me I'd have to be leaving because the family was going on vacation and they didn't want to leave me in the house by myself cause they don't exactly know me very well. He locked it intentionally. Seeing how I had a key to the house I don't see how its breaking and entering, as for MDOP.. it would be a minor if anything. I have spoke to him but I don't feel obligated to pay the $130 if he has the right to do that and give away my possesions.

    And as for court, no I have not recieved papers, he knows my address. I don't believe he's taking it to court because it's only little damages.

    As for my other topic, thats more important to me. As dumb as it may sound.

    We lack psychic powers here - we don't know if he made a police report, or if a prosecutor will authorize charges. If you had a key and lawful access to the rest of the house, but were locked out of your designated bedroom where your belongings (and pets?) were located, I suspect he is exaggerating. But I simply have no way of knowing. Whatever the case, you damaged his home and you should reimburse him for the damages you caused. If that ends things, all the better.

    Yup, it's pretty dumb.

    If I caught my 16 year-old on a board like this, talking the nonsense you've been talking, I'd smack him back to the womb for a do-over.

    As my esteemed colleague notes, we are not possessed of ESP. You've got to pay what you owe and hope he hasn't filed charges. If he has, you've got a pile of trouble.

    You've got to get your priorities straight. The world is a very ugly, ugly place, and your unrealistic approach to it is only going to result in tears, pain, and possibly jail.
