My question involves a background check in the State of: kansas

When i was 16-17 (i am 21 now) I was just inside the gate that lead up a ways to a hill. I didnt do anything, i was just there so i got a tresspassing charge. I was never arrested for it. I was not able to get a diversion b/c they charged us together instead of separate. I fullfilled my unsupervised probation for a year and didnt get into any more trouble.
well, not that long ago-little over a month ago- I got a misdemeanor ticket for shoplifting, dumb i know- it was the 1st time i had done it and got caught. i feel horrible about it and after it happened i didnt eat for 2 days and slept all the time. oh, and i wasnt arrested for this either.

i had a court date last wednesday and told them i want to get a diversion and they asked me if i had been in trouble for anything else-including juvenile and i said no. (isnt it sealed when youre 18 anyway?) so now, i have a court date in mid august to pay the $350 to get a diversion. I am frantically calling around to lawyers to see if i can get the juvenile offense expunged so that it will not show up. so that i may indeed get the diversion and not ever get into trouble again. ive talked to a couple of lawyers and they said expungement takes around a couple of months.

so one of my questions is... can i get/would it be a good idea to get a continuance again in august so that when they look to see if i can get the diversion, the juvenile offense will not be on there b/c it would be expunged by then...?

i just started a good job and they are going to do a background check- my other question is if they are performing a background check on me right now, will the shoplifting offense show up since i havent necessarily been convicted of it and want to be put on diversion..? also, since the other charge is juvenile misdemeanor will that hurt me?
