My question involves criminal law for the state of: Tennessee
My son (an adult) was arrested for tresspassing and public intoxication in another county. He went to court alone and was under the impression that charges were dropped.
We found out that he was put on probation when the county he lives in ordered him to appear in court. We thought it was related to his DUI that he is currently on probation for in the county he lives in. They arrested him and transported him to the county where he was ordered to show up for probation.
My son has been diagnosed with ADD and truly has trouble with instructions ext. We have not recieved any calls or letters from this county concerning his probation violation. He would have showed up if we knew.
What is the courts responsibility or proceedure for notification of orders for probation? Is there any presidence for leanancy or forgiveness in these situations?
