    Default Underage Drinking

    I was leaving a party where I was drinking when me and my boyfriend were attacked by five black males that proceeded to kick my boyfriend unconsious. I was being held back at the time and there was nothing that I could do, I watched him get beat, I yelled "COPS" and all of the males scattered. I was lying in the snow and ice with my unconsious boyfriend bleeding from the mouth, I was screaming for help and no one would help me so I called 911 to get an ambulence. I am only 19, but my boyfriend is 21, when the cops and ambulence came they drove him to the ER and I had to ride along with a cop, she asked me how old I was and i told her and then when we were in the ER. She was writing down my statement of what happened and she asked me for my ID, I told her that i did not live at the address on my ID because I had just moved, I then gave them my new address. She handed my ID to another cop and about 15 minutes later he walked up to me and said that I was getting an underage consumption. They did not ask me if I was drunk, they did not give me a breathalizer, and they did no field tests, they also wrote my old address on the ticket (which they also got wrong, they put down the wrong house address). I asked them why i was getting it and they said it was obvious that I have been drinking. If i was faced in a life or death situation can they give me an underage? Also, can I fight the ticket because of the fact that there is no proof that i was drunk besides the fact that I smelt of it and also because the address was wrong on the ticket?

    Does one have anything to do with the other? The police observed that, in their opinion, you had committed a crime, and they issued a citation.

    The "wrong address" (the one from your driver's license) isn't going to result in dismissal.

    You may have a decent argument in that no sobriety tests were administered, and similarly no breathalyzer or BAC was administered. Of course, if you had blood work done at the hospital, they may have measured your BAC.
