    Default Neighbor's Tree Nuisance

    My question involves real estate located in the State of: New York. My neighbor's tree overhangs my driveway and house. A tree specialist has identified several dead branches. My plan is to tell neighbor that we plan tohave dead branches pruned and ask to share cost. I understand i have a right to cut anything hanging over my property, but if i cut without their "consent" and then tree falls and damages my property, do i have any liability (claim that by pruning we caused tree to fall). I think was they are on notice that tree has issues, they are liable for any damages. Mostly, i am worried about my kids being hit be falling branches, so i will cut tree anyway, but i want to understand the our rights vis a vis our neighbor.

    If you damage your own property by pruning the tree carelessly, you are responsible for the damage you cause.
