    Default What if the Probation Officer Never Finds Out

    My question involves criminal law for the state of: Louisiana

    It's been 16 years now but while I was on probation for forgery I was set up by an informant who planted a small crack rock on me while we where making out in my car. She then told me to follow her to a motel room and on the way I was pulled over by the cops and they found the rock she planted. They read me my rights and hand cuffed me. But to my surprise all the cops just suddenly left except for this one narcotics officer. He then told me that if I would inform for him he would not tell my PO. I agreed at the time just to get away. A few days later however I had second thoughts. I called him and told him that I would not be an informer because I didn't know any drug dealers and I had no history of drugs. Plus the rock was not mine as it was placed in my car without my knowlege. So I decided to take my chances on the legal system. Well I waited for the knock on the door but it never came. I was required to report to my probation officer once a month but the very next visit to him after the incedent he never said a word about it. In fact he never found out about it. I went on to finish my 2 year probation period and was satifactorily discharged. I guess obviously the narcotics officer never reported the incedent or told my PO because I was never arrested. The narcotics officer knew where I lived, where I worked and knew who my PO was. I told him everything. He even looked up my record and found the forgery conviction for which I was still on probation but nothing ever came of it inspite of me refusing to inform. I was very easy to find if the cops were looking for me because as I said I told him everything but yet never arrested.

    Ok, so my question is this: If there was an outstanding warrent for the incedent and charges were still pending, would that effect the completion of my probation? I mean could they charge me for violating my probation after I have already completed it?

    It's unlikely you would have been successfully discharged from probation had there been a warrant pending, as that's usually checked by the probation officer. (But I can't make guarantees. Mistakes happen.)

    Well that never occured to me but you are absolutely right. He commended me at the completion of the probation for my success and never mentioned anything. I have also had drivers licenses renewed since then with no problems.
