    Default Emancipation To Get Into College

    My girlfriend is currently 17 and living with her parents. She will graduate from high school this year and is planning to go to college this fall. This is where the problem comes in. I know that she want to go to college but her parents refuse to help her financially. Though they refuse they still say they will claim her on their taxes. Because of this their income is shown when she applies for grants. Now they make alot of money so she will be unable to get any grants based on need when in fact she is in need because she gets no support. Is there anyway for her to empancipate herself in order to show only her income so she may get grants based on need or is she out of luck and must rely on scholarships and loans. Someone please let me know or direct me to who you think I should speak to. Thank you.

    Default College Financial Aid Policies

    You should check with the financial aid office of the college(s) she hopes to attend - it is quite possible that even if she had an order of emancipation, they would expect parental contribution. They may have a procedure by which she can demonstrate that she is self-supporting, and thus not required to submit proof of parental income or to obtain parental contribution toward college costs.

    That is true, but I am wondering because it is the us department of education that posts the childs income not the financial aid office so i didnt know if i had to do something federally binding

    IF DOE is receiving and passing info from IRS, perhaps youngster can get a notarized statement from each parent as to their intent to not pay for college and he/she can then in turn, issue injunction against DOE.....since schools she applies to would then be in the dark and award her based on what she can show of her own savings and other sources of contributions......

    just a thought?

    You would need a pro bono, child advocacy lawyer....you might check the list of "GAL's" available to judges of Family Courts in your location.....

    States like NH forbid a judge from ordering parents to pay such if over age majority.....
    Other states...Iowa, CA, MA ....may well try to find a novel cause of action...
    States like CT....limit (divorce based) college support of adult child, to State School amounts....
