    Default Suing a Roommate for Unpaid Rent

    My question involves a roommate in the State of: Florida

    My roommate moved out and is refusing to pay rent. Do we have to wait until the end of the lease to sue him for the rent? Also, his mother has been paying for a last few months, can she be included as some sort of assumed responsibility...

    The typical approach: Look for a replacement roommate, then sue him for the unpaid rent accrued before the new roommate moved in (and the difference in rent if the new roommate is paying less than he did). If you want to try to sue him for each month's rent, you'll spend a lot of time in court.

    Mom's not liable just because she helped him and you out by paying his rent for a few months.
