I Want to Get Emancipated

My question involves emancipation laws for the State of: florida

Well after my mother died in 2001 my brother became my leagal guardian. we moved from New york to florida in 2004. He had custody over my sister also but she is now 20 and free of him but im only 16 and i dont think i can live the way im living for 2 more years. My brother is not a good guardian he's a good brother but not a good guardian. i havent lived with him since i think 2006 and he stays with his girlfriend while i stay with my other brother and his girlfriend and a baby all in a one bedroom apt. and ever since i moved to florida i believe i have moved more than 8 times and ive been here for only 4 years and i have lived in hotels. My brother cares more for his girlfriend than he does for me if im sick and need to go to the hospital he is not there and barely ever answers his phone. He is always there for her. He also gets a check for me every month from social security for about $800 but i dont get any of it and the brother that i do live with struggles every month trying to pay the bills. So i was wondering if i even had a chance to be emancipated.

You would be better off to find another relative to obtain custody of you. Your already living with your other brother. If he is of the adult age maybe he should obtain custody of you.

When your custody changes your ssi payment will follow you. There for the brother that is only housing you for the money will loose that money.

I just went through this with my wife's 15 year old cousin that lost her father. Granted the 15 year old is way better off in my house then any other option out there. The court seen that and granted my wife and I gaurdianship.
