My question involves labor and employment law for the state of: Ohio


In March of 2001, I was convicted of a felony 5 domestic violence. I had two prior convictions of misdemeanor domestics as a juvenile. The prosecuter was determined to give me a felony because of my two priors as a juvenile. I have not been in any kind of trouble since and have nothing else on my adult record. (other than a few speeding tickets)

About two weeks ago I interviewed at Lowes for a position. The interview went great and at the end I was offered employment. On the application I was honest and told them about my conviction. During the interview I even asked the gentleman about my conviction and if it would be a problem. He told me that if I was honest on my application then it did not matter. Today, I decided to call and find out what was going on. I talked to the guy I interviewed with and he told me my offer for employment was recinded because my background check came back unapproved. He told me the only information that he had received was that I was unapproved and he had to recind the offer for employment.

I have a couple of questions about this.

Is this considered descrimination and if it is, is there anything I can do about it?

Would I be able to get my record expunged?

I have been googling various things for the last hour and it sounds as though there are some laws pertaining to convictions. I was hoping some of you would be able to help me out and point me in the right direction. Thank you in advance for any help.
