    Default Entry into Canada with a Misdemeanor

    Hope this is th right place, don't really know were to put it.

    So heres the deal: I am applying for a job that involves entry into Canada and must clear up the matter of being inadmissible into Canada and filing an application to be considered rehabilitated by the Canadian Government.

    Info:

    11/2001 Charged with Petty Larceny in NY.

    01/2002 Convicted of Petty Larceny.

    01/2002 Sentenced to pay $200 fine.

    01/2002 Given 1 year conditional discharge.

    11/2007 Given a certification of relief of disabilities for conviction above.

    OK...what exactly is your question?

    Are you asking if that's enough to be considered rehabilitated?

    Have you consulted an immigration attorney?

    Yes, it enough to be considered rehabilitated?

    How long will it take to get all of this done?

    I have since contacted the Canadian embassy in NYC and the lady I spoke with informed me it will be $200 Canadian to process and could take 1-4 months... Does it usually take 4 months or does 1 month sound more like it?

    I also asked her about their website saying the fee ranged from $200 - $1000 Canadian and if the $200 was not enough you would be informed to send $800 more... I asked what the chances are I would be asked to send $800 more (that I cannot really afford right now)? She said that was only if my case required the prime ministers approval, and that approval is only really needed in cases of felonies...

    As with our government and state agencies you could talk to two different people and get two different answers.... Does the lady in the NYC sound pretty right on the ball with her statements?

    As far as consulting an attorney, is that really necessary? Is this application something I can fill out on my own? I was told it really is... Any other reason I might need an attorney? If I could afford it I would opt for an attorney to handle it for me, but as I said I am doing this so I can apply for a new job as my current job has been cut to about 16-18 hours per week. I cannot really afford an attorney if it is not absolutely necessary. However, if there is anyway to expedite the process or make it any easier, I guess the fee would be worth it.

    One more question...

    I don't know if this has always been the law or if it was simply impossible to enforce before 9/11.

    I know that the information shared between the US and Canada since 9/11 makes it easy to know instantly who is admissible and inadmissible with a few key strokes...

    Heres the thing, is it true a Canadian border patrol agent can make the decision at the point of entry?

    I have been in Canada since my conviction, is it possible I was deemed rehabilitated or was deemed not be inadmissible upon entry once or all of those times? Or was it that the information sharing policies between the US and Canadian was not in full swing at that stage and did not know I was inadmissible? Is there any way to find out if they deemed me rehabilitated or not inadmissible?

    That is why I was wondering if I was inadmissible or not. I remember at the border when my friends and I handed over our ID's when they asked if anyone had been convicted of or currently charged with a felony in the US... ...I also remember another time at the border the agent asked who (my name) was... I answered and he asked if I was ever convicted of a felony... ..I told him no a misdemeanor, he handed me my ID and told me to enjoy my stay in Canada...

    Jut wondering if any of that makes a difference or not?
