    Post Security Deposit Abandonment

    My question involves an eviction in the state of: Florida: I had tenet give me 500.00 dollars toward a 825.00 security deposit two and a half weeks ago to rent a house I had for lease. So I removed the for lease sign. The tenet was supposed to take possession of the house on the first of the month and pay the remainder of the security deposit. 325.00 plus, 825.00 first month rent. I called the tenet and his wife at the #s on the rental application and no answer no call back I called him and his wife and left messages on the 2nd and 3rd of the month. no call back or show. The receipt for the deposit was tentative per the lease being signed on the first of the month. The house is in perfect move in condition. What can I do legally in Florida?

    Did they sign anything in relation to this transaction? If so, what did it say? How's the search coming along for a replacement tenant?

    i signed and they both signed that this was deposit toward the lease of the rental property and this was a partial deposit. It also said that this deposit was not considered the amount to move in . this was solely a portion of the security deposit to hold the unit until they paid the first months rent and remainder security deposit over the next three months. 100.00 for two months and 125 for the last month. the first months rent was due on the first total 825.00 plus 100.00 to recieve the keys. i've never had anyone go through the approval process and pay a sustantial amount and not show up to take possesion of the property no show no call. what action can i take the day is the 7th. or do I wait and see if they call back. if so how long.

    Did what they signed actually say "this [is] solely a portion of the security deposit to hold the unit until [you pay] the first months rent " and that it would be forfeit if they did not ultimately sign a lease and move in? Have they asked for the money back yet? As you were previously asked, how's the search coming along for a replacement tenant?

    This was not in the agreement. "and that it would be forfeit if they did not ultimately sign a lease and move in". but it did say that the amount paid was for holding the apartment and not the acual amount needed to move in the apartment. and the answer to your question is no i have not attempted to repost the for rent sign or look for new tenants. no i have had no contact with the tentative tenants even though i've left numerous messages.
