Default Termination Of A Father’s Parental Rights

My question involves a child custody case from the State of PA. My daughter is 8yrs old. She has not seen her "real father" since she was 8 months old. He is in jail for life for muder and he never has been in her life to start with. Can his rights be terminated or do I just have to settle for SOLE custody. There is no one to adopt her but I just do not want her to have to ever deal with him.

Incarceration is not sufficient grounds to terminate his rights.

Sole custody appears to be your only option. Since he's in prison for life, it's unlikely your daughter will have to deal with him at all anyway.
