    Default Brand Trade Marks and Business Names

    If a (national) store has a private label brand that is trademarked and is only sold in that store, would it be an infringement to use that private label brand name as:

    1) a business name?

    2) a website domain only?


    For example (made up), the store's name is Three Rivers and they have a private label brand named Three Creeks. I'm interested in a business name and URL for Three Creeks that would not be selling any private label products under that name but only reselling other products.

    Could I used the name Three Creeks and Ponds? The national store does not have a trademark for " Three Ponds", but I need the Creeks in the name primarily.

    Unless your products and/or services are vastly different than the ones offered in the store, I think you have a problem.

    This is definately a "get an attorney" issue.
