My question involves child support in the State of: Texas
My step-daughter has not lived with her mother since August, 2007. She is now 17, has a baby and lives with her boyfriend and his family. She has lived with them since her mother asked her to leave in August, 2007 when she came out pregnant. Our question is this, the mother continues to collect child support and refuses to give my step-daugher any of the money, $500/month. The step-daugher is now on as many government assistance programs as she can qualify for. She is also no longer enrolled in high school and has just received her GED this summer. DO WE STILL HAVE TO PAY CHILD-SUPPORT? Also, is there any way the step-daughter can get the $5000 her mother has not been using for her or given to her? Neither of us can afford an attorney and her mother's best friend is an attorney, so we feel very much at a loss.
Here is a copy of the child support order:
1) any child reaches the age of 18 years, provided that, if the child is fully enrolled in an accreditied secondary school in a program leading toward a high school diploma, the periodic child support payments shall continue to be due and paid until the end of the school year in which the child graduates;
2)any child marries 3)any child dies 4) any child's disabilities are otherwise removed for general purposes 5)any child is otherwise emancipated
