    Default What's the Sentence for Accessory to Murder

    My question involves criminal law for the state of: Kansas
    If the case that is over 20 years old has gone to trial and the invidual involved is already serving life sentence. if there was another invidual present at the time of the homicide was not aware of what was going to happen and the case was re-opened with some new evidence. if the invidual was tried as an accessory ....what is the sentencing (maximum/minimum)for accessory to a murder?

    I have not been able to find a clear answer for this outside of the possibility of life without parole.

    The individual in question should be consulting an attorney immediately instead of addressing such a serious situation to strangers on the internet.

    I have not scoured the KS statutes, but generally inchoate offenses, such as conspiracy/complicity/accessory.. carry the same penalty as the main perpetrator.

    I do know, without looking though, that the US SC has ruled the NON trigger man in a murder, even though conspiring to commit, say, a bank robbery, can NOT be sentenced to death IF they had no knowledge of the forseeability of a murder, just a robbery.

    You need to sift through the KS stautes, preferably in person at a library instead of online, since at times some states are hard to go from page to page, etc.
