My question involves a speeding ticket from the State of: California
her is the lowdown. i was on PCH in Long beach last night. the section of the PCH thet i was on was 3 lanes. i was in the right lane coming up to a light. all other lanes were stopped. in my lane, apx. 250 ft. ahead were parked cars. when the light turned green, i gassed it to get across the intersection ahead of the other cars in my 05 Camry, and made a legal and safe lane change. i never broke traction, nor did i break the speed limit of 40 mph.
the police car pulled me over on the on ramp to the 710 freeway. one officer came to my window, and asked me for license and reg. which i promptly provided. i asked why i was pulled over, and he said exhibition of speed and speeding.
i questioned this to him, and we had a bit of a friendly conversation about it.
meanwhile, there was an officer on the other side of the car saying to turn the car off (which i didnt hear) and he was getting angry that i wasnt turning it off. mind you, i am on the shoulder of the on ramp to the freeway focusing on the officer on my side.
after the one on the passenger side got loud, my wife turned the car off from the passenger side. my 3 children in the back of the car by now are a bit less than comfortable with the situation.
now, the officers go to the back of the car to confer on the ticket, or warning. (the officer i spoke to lead me to believe it was just going to be a warning if all of the paperwork checked out.
then the officer that was on the passenger side comes up with this ticket, and asked me to sign. we spoke about it for a moment, where i denied exhibition of speed, and even speeding as i did not go over the 40 mph posted speed.
he said i think you were going 45 do you agree with that? i said NO. he said there was no point in arguing with him on it. i asked to see the radar, or how he determined i was exceeding the speed limit. he said i would have to go to court to find out if he used radar.
this whole thing was handled in a very unprofessional demeaning manner by the second officer. i was taking the time to read the ticket before signing, and he got snappy with me to sign it and give it back in a forcible tone.
i explained that i like to read whatever i sign, and he got more attitude with me.
he then handed me the ticket and insisted i leave NOW from the shoulder of the road. i explained that i would when it was safe for me to pull out onto the freeway. he bullied me with the loudspeaker on his patrol car to pull out NOW.
i realize there is likely not much i can do about the demeanor of the officer, but i am curious how i can handle this ticket. i honestly think i was not in the wrong on any of my driving actions in this instance. no speeding (Though he wrote 45mph) and no exhibition of speed having not broken traction. the lane change was legal with blinker, and well across the intersection.
how do i win this or get it dismissed?![]()
