    Default Firing a Pellet Gun at Duck

    My question involves criminal law for the state of: Pennsylvania
    My friend took a airsoft or pellet gun and fired blank shots at some ducks to see if he could scare them, and some angry lady took pictures of him, and me standing next to him while he was holding the gun. Then she called the cops, and told us "i'm calling the cops" so we walked away.. and left the area. All i know is that the officer has our names and a description of my friends vehicle. What kind of charges can/might be pressed. Thanks.

    I would think that the charges would be along the line of animal cruelty.

    So even though shots weren't fired we/he could get in trouble?

    I would suspect hunting without a license unless you can get them to believe you were shooting blanks.

    How do you shoot blanks with a pellet gun anyway?

    and I would not expect the authorities to believe you were shooting blanks.

    To be specific it was an airsoft gun. It shoots plastic pellets at 200-300fps. There was a clip in it, but it was empty so when it was fired it made a shooting noise louder than actually shooting a pellet. We were dryfiring it to see if we could get the ducks to fly away.

    and I suppose you can prove that, right?

    wrong.

    A reasonable person is not going to believe you were out with any sort of rifle and had the ammo in your pocket and were simply aiming at the ducks and pulling the trigger to scare them with an empty gun.

    a good "hey ducks" at the top of your lungs would do as well.

    Being ducks are Migratory Birds and fall under Federal and State hunting laws. You could be facing serious offenses.

    Even though the gun at hand is an air soft gun. Does not matter, because it is against federal law to harrasse migratory birds. Which in your own words is basically what you were doing.

    Also in your first posting, you say pellet gun or air soft gun. So which one was it. You later declare it was an air soft gun. But your posting conflicting stories.

    As of right now, I would not do this type of activity again. You have not been charged with anything yet. If you are charged with something seek a lawyer before answering any questions.

    if they have no pictures of you actually firing at the duck then they have no case unless the lady will testify on stand that she saw you firing at the ducks with her own eyes and even if she do that they probably will still be hesitant to charge for lack of evidence. Detectives will probably try to scare you and your friend into telling on yourselves
