    Default T-Boned by Truck Running Stop Sign

    My question involves an injury that occurred in the state of: California

    On Friday June 27th at 10:30 pm I was hit by a man who punched it through a stop sign not paying attention to the road. At a 4 way intersection into a shopping center there are 3 stop signs that must all yield to incoming traffic. I was entering the center and turning left into the vons gas station in mira loma when I was t-boned going 10mph in my 94 mazda truck by a man driving a 2003 toyota tundra coming straight at me at ~35mph. He has damage to his front passenger corner and the whole passenger side of my truck is caved in.

    After the accident he told me that he didnt see me and that he had full coverage insurance with Mercury. That was a relief because I didnt. He was taking full responsibility, which he should, so I felt that the police were not needed to just further compound his problems. I took pictures, his name, number, address, age, VIN #, License Plate#, and an old copy of his ins. card and told him I would call him in the morning. I told him that I was O.k. but I was full of adrenaline. My left knee had hit the drivers door hard and my lower back was stinging. I just wanted to get to bed.

    I called him at 9am on Saturday to ask what he wanted to do. Being a nice man I was going to let him buy my truck for 3000$ and be done with it. He said it would be best to contact his insurance company. So i hung up and did. I gave them a statement of what happened using proper direction and telling them of the damages to the vehicles. And they told me they would contact me in a week!

    On monday I made an appt. with my doctor. On tuesday I saw my doc. and told him what happened. He scheduled me an appt. for monday the 7th to get an x-ray on my knee and lower back.
    On Wednesday mercury came to take pictures and a recorded telephone statement from me.

    Yesterday morning, without any word in almost a week, I called and asked to speak to a supervisor. He immediately got angry with me and told me they "have 45 days legally to determine what happened." He said "their client has not made a statement yet and they have hot taken picture of his car yet." !!! "As of this time the other driver is denying fault and we are going to investigate." Then he goes on to tell me that they have their clients interests to protect and since I didnt have full coverage I am screwed until they figure out what to do.

    I do have a witness who approached me after the accident and when I entered the gas station and gave me his info. The insurance company didnt seem to care!
    Forgot to add that yesterday I went to the local sheriff's station and wanted to file a police report. They sent me to Highway Patrol .
    While at both police stations I was told by the sheriff's that since the accident happened on private property and no one was injured at the time of thge accident that they probably wouldnt have come. The highway Patrol office told me that its not in their jurisdiction unless on a major highway or there were injuries close to that highway. Im so lost here...

    WHEW...what do I do now? DO I contact a lawyer??? Please help.
