My question involves insurance law for the state of: Texas
I was traveling in the far right hand lane of a 3 lane access road. A truck in front of me slowed and signaled to turn. I checked my mirrors, signaled and proceeded to move into the next lane. I accelerated a few seconds in the lane and was struck from a car from behind. The car was traveling at what appeard to me and another witness at a high rate. The witness that was behind me verified that I signaled and moved into the next lane. he also told the police that he was in the process into the other lane when I was struck.
I told my story to the police and the insurance without knowing what the other driver was saying. I told my story to the insurance company and they are telling me that his story is completly different. How do insurance companies determine if one side is lying or not. I do not know the other guys story but me and the witness clearly stated that he was traveling at a high rate.
could i really be at fault? i signaled, moved into the other lane and established my presence in that lane. or was his lack of attention and driving at a high rate make him at fault.
