    Default Holiday Pay for Holiday Occurring on Non-Work Day

    My question involves labor and employment law for the state of: Arkansas

    I work in Arkansas for a business designated as an "S Corporation". Our employee manual includes "Independence Day" as a paid holiday. However, we work a "four-ten" workweek ( Monday - Thursday - 10 hour days). Since we will not be working on the 4th of July, are we entitled to holiday pay?

    No. You are not.

    NO employee is "entitled" under the law to holiday pay. Holiday pay is not required by law in any state. (Exempt employees cannot be docked in the case of a holiday-based company closure - that's as close as it gets.)

    For those employers who choose to offer holiday pay, it is quite common and quite legal for employers to pay only those employees who would have been working on the day in question.

    You should check your employers policy book. there could be in lieu of holidays that you could be entitled to pay. If you normally got paid for them when they fell on the days you did work then either you should get paid or have another day off in return.

    Unless a bona fide contract or CBA specifically says otherwise, no law in any state requires an employer to provide holiday pay or another day off for employees who do not work on the holiday, no matter what the circumstances.
